NYC renters thinking about Airbnb listings need to be in the know

Increasingly (and not just in NYC, but in major metros all across the country), the ins-and-out relevant to Airbnb listings can become important to know for a lessee seeking to earn some income through a short-term rental of their dwelling.

Is that even permitted in New York City?

Many people might automatically think that it is and simply go ahead with the process. In some instances, there are no legal constraints that bar them doing so.

In other cases, though, true peril can ensue. Numerous national media sources are currently relating the tale of one NYC resident who profited from putting her rent-stabilized unit on Airbnb multiple times several years ago to help defray her spouse’s medical bills.

Her landlord took her to court for that, citing a city law that bars subletting rent regulated apartments for profit.

And she lost. In fact, a Manhattan judge recently approved an order for her eviction from the dwelling she has resided in for decades, and additionally slapped her with a $185,000 fine.

The story obviously reflects an extreme case. It is certainly instructive, though, for its takeaway that harsh penalties within a broad spectrum of possibilities can befall any tenant who sublets a dwelling without first being fully knowledgeable concerning applicable laws.
